Liability Waiver and Release — DRAFT

DRAFT — the shop's own wording, which may still change before bookings open. It is the shop's first draft of what it intends to say. Phase 7 of the build replaces this file with the full draft set.

Version 0.1, 21 September 2026. Applies to: every calibration sold by the Bore and Stroke Tuning remote calibration service. Accepted on the booking form before checkout; the version accepted is stored with the booking.

1. What you are buying

A custom engine calibration file, written from a read of your own engine control unit ("ECU"), for the vehicle, fuel and hardware you describe on the intake form. It is delivered as a file and instructions. It is not installed by us, not tested on your car by us, and not a dyno tune.

2. Off-road and competition use only

Every calibration is sold for off-road and competition use only, on vehicles not operated on public roads. You are responsible for knowing and complying with every emissions, noise and vehicle-construction law that applies where you live and where you drive. We do not represent that any calibration is lawful for road use anywhere.

3. Emissions, inspection and warranty

Modified engine software may disable or alter emissions-related functions. It may cause the vehicle to fail an inspection or emissions test. It will likely void some or all of the manufacturer's warranty; the manufacturer can detect it; and restoring the original software does not necessarily restore the warranty. You accept each of these.

4. Mechanical risk

Increasing engine output increases mechanical stress and the risk of damage to the engine, the transmission, the drivetrain and other parts. You are responsible for the condition and maintenance of the vehicle, for running the fuel you declared, and for stopping and reporting any knock, misfire, warning light or abnormal behaviour. You accept the risk of loss or damage arising from running modified software, including loss of the vehicle and consequential loss, to the fullest extent the law allows.

5. Your stock file

Before any modified file is written to the ECU you must save an unmodified read of it. If you proceed without one, restoring the vehicle to stock may be impossible or costly and that is your responsibility.

6. Accuracy of what you tell us

The calibration is only as safe as the information it is written from. You confirm that everything you tell us about the vehicle, its modifications, its condition and its fuel is accurate and complete. A calibration written from wrong information is not our fault and is not a refundable error.

7. Release

To the fullest extent permitted by law, you release [FILL IN — legal entity name], its owner and anyone working for it from all claims, losses, damages and costs arising from the use of a calibration we supply, however caused, except where the loss is caused by our fraud or by negligence that the law does not allow us to exclude.

8. Refunds

See the Terms of Service, section 3. In short: a booking is refundable in full until we start work on your file; once a file is delivered, the work is done and the fee is earned, and we will instead keep working the revisions your tier includes.

9. Acceptance

You accept this waiver by ticking each acknowledgement on the booking form and typing your full name. The acknowledgements, your typed name, the version of this document, the time and the network address of the submission are stored with the booking as the record of acceptance.
